Terms of Service

These terms govern your use of Trakt. By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
They are written to be read. Where something is genuinely a limit on what we promise, it is stated plainly rather than hidden in capitals.
The service
Trakt is a hosted lead-intelligence and attribution tool. It records visits to a website you control, captures submissions from forms on that site, attributes them to the campaign that produced them, and tracks the resulting leads through a pipeline to closed revenue.
We provide it as-is and improve it continuously. Features may be added, changed, or withdrawn. Where a change removes something you depend on, we will give reasonable notice.
Your account
You are responsible for the accuracy of your account details, for keeping your credentials secure, and for everything done under your account. Tell us promptly if you believe it has been accessed without your authorisation.
Accounts sit inside a workspace. Whoever administers a workspace controls its membership, can invite and remove people, and can see the data in it. If you join a workspace belonging to an employer or a client, they control that workspace and its data, not you.
Plans, trials and billing
- There is a free plan. It is free indefinitely, subject to the limits shown on our pricing page.
- Paid plans include a 14-day trial and require no card to begin.
- Paid plans are billed monthly in advance through Stripe. We do not currently offer annual billing.
- Fees are non-refundable except where the law requires otherwise. Cancelling stops future charges; it does not refund the current period.
- You can cancel at any time from the billing portal. Your account moves to the free plan at the end of the paid period.
- If we change our prices we will give at least 30 days' notice before the change affects you.

Your data stays yours
You own the data you put into Trakt, and the visitor and lead data we collect on your behalf. We claim no ownership of it. We process it to provide the service to you, on your instructions, as described in our privacy policy.
We do not sell your data, we do not share it with other customers, and we do not use it to train machine-learning models.
You can request an export or deletion of your data at any time. On account closure we will delete or return it on request. confirm: the deletion window you are willing to commit to, e.g. 30 days

Tracking visitors: your responsibilities
This section matters more than any other, because of what the product does. When you install our script on your website, you decide what is collected and why. Accordingly you agree that:
- You will only install the script on websites you own or are authorised to operate.
- You have a lawful basis for collecting visitor and lead data, and you will obtain consent where consent is required in your visitors' jurisdictions.
- You will publish a privacy notice telling your visitors that this collection happens, and what you do with it.
- You will respond to your own visitors' access and deletion requests. We will help, but the obligation is yours.
- You will not use Trakt to collect special-category data — health, biometric, racial or ethnic origin, political opinions, religious beliefs, sexual orientation — or data from children.
- You will not place the script on pages where tracking would be inappropriate, such as pages behind a medical or financial login.
If you breach this section we may suspend the affected website immediately, because the exposure runs to your visitors as well as to us.
Acceptable use
You agree not to:
- Break the law, or infringe anyone's rights, using the service.
- Send unsolicited bulk email using data collected through Trakt.
- Attempt to access another customer's workspace or data.
- Probe, scan, or load-test the service without our written permission.
- Resell or white-label the service without an agreement with us. Using Trakt to manage your clients' accounts inside your own workspace is expressly permitted, and is what the agency plan is for.
- Reverse-engineer the service, or use it to build a competing product.
Third-party integrations
You may connect third-party services such as Google, messaging tools, or form providers. Those services are operated by other companies under their own terms, and we are not responsible for their availability or for their handling of your data once it reaches them. Connecting one authorises us to exchange the data necessary to make the integration work; disconnecting it stops that exchange.
Availability
We aim to keep Trakt available and will schedule disruptive maintenance considerately. We do not currently offer a contractual uptime commitment, and there is none on the free plan. confirm: whether paid plans should carry an SLA, and at what level
Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate an account that breaches these terms, that does not pay, or that puts the service or other customers at risk. Except where a breach is serious or unlawful, we will tell you first and give you a chance to fix it.
Disclaimers and liability
Attribution is inference, not certainty. Trakt reports what it can observe, and real customer journeys include steps no tool can see — a conversation, a word-of-mouth referral, a device we were never on. Treat our figures as strong evidence for a decision, not as an audited account. We do not warrant that the service will be error-free, or that its attribution will be complete or exact, and we are not liable for business decisions taken on the basis of it.
To the fullest extent the law allows, neither party is liable for indirect or consequential loss, or for lost profits or revenue. Our total liability in any twelve month period is limited to the fees you paid us in that period. confirm: liability cap, and whether the free plan is excluded entirely
Nothing here excludes liability that cannot lawfully be excluded.
Changes and governing law
We may update these terms. We will update the date at the top, and for material changes we will notify account holders directly. Continuing to use the service after a change means you accept it.
These terms are governed by the laws of confirm: governing jurisdiction, and disputes will be heard by the courts of confirm: court and venue, or arbitration if preferred.
